The Process of Getting a Work Visa for Brazilian Citizens in the USA
A process called "naturalization" lets people from Brazil who come to the US become Americans. This goes along with permanent residency and gives you the same rights as if you were born in the US. As a permanent resident, you can go through this process after five years. If you are married to a US citizen, you can go through it after three years. Besides these, there are a number of other factors that will be used. You need to:
- At least 18 years old
- Have legally lived in the US for the necessary amount of time
- Learn to read, write, and talk English
- Do not have a criminal past and have good morals
- Learn about government and history
- Be true to the US Constitution.
Say "I promise to serve"
You can apply by filling out Form N-400 once you are sure you are qualified. You have to show that you are qualified and give information about yourself and your family on this form. You can fill out this form online or on paper and send it in.
You need to pay the $640 application fee and the $85.00 fingerprint fee when you send in Form N-400
How to Become a US Citizen Through the MilitaryYou can also become a citizen of the US if you have been in the service. The only time you need to serve is for one year or during a hostile moment in order to become a citizen. Since there has been a climate of hatred since the 9/11 attacks, this way to become a citizen will be open to anyone who is in the US military and has lived in the US for five years. You must also have served honorably in the service in order to be eligible. If you were in the military, you must show that you did not get a dishonorable release. The Form N426 Request for Certification of Military or Naval Service is another form that needs to be filled out. As this form shows, your service is what it says it is. The best thing about this type of naturalization application is that you might not have to meet certain requirements. If you meet certain conditions, these rules may not apply to you. Among these are the skills to:
- Learn to read, write, and talk English.
- Show that you know about US past and government.
- Be true to the US Constitution.
- Reasons for Not Being Naturalized How to Apply
Getting citizenship is a big step for Brazilians who want to move to the United States. Before they are accepted, applications are carefully looked over. If an entry is turned down, it could be because:
- You have a history of crime.
- You don't pay child support that's due in the US.
- Some or all of your taxes are not paid.
- You lie or cheat on your application for citizenship.
- You did not live there continuously for the required amount of time.
At the citizenship interview, you fail both the English language test and the civics test. If you fail the test, you have 90 days to take it again.
If you are a guy between the ages of 18 and 26, you don't sign up for selective service.
A K-1 Fiancé Visa is often given before the marriage-based Green Card. Until you get married, this visa gives you the same rights as a permanent resident. It's for Brazilians who care about US people. For this visa, you need to meet a number of conditions, such as:
Someone who is a US citizen must ask for the visa
Neither partner can be married to someone else (if they were married before, they must show proof of divorce or death).
They had to have known each other for at least two years before they applied.
If you have a K-1 Fiancé Visa, you can also bring your kids to the US. They will need a K-2 Visa for Dependents, though. This choice is also open to LGBTQ+ couples, just like the marriage-based Green Card. It costs more to get a K-1 visa than some other types of foreign visas. It costs a total of $800. Status Change from a K-1 Fiancé Visa to a Green Card Based on Marriage To make your move from Brazil to the US permanent, you will need to switch to a marriage-based Green Card after getting married to a US citizen. At first, you should see if there are any reasons why you shouldn't be admitted. Some of these are:
- According to the Department of Health and Human Services, having a sickness that can spread
- Being hooked on drugs
- Being disabled in a way that could make you act dangerously toward others
- Not being able to show any proof of vaccination
If any of these things are true, you need to get a waiver of inadmissibility. You need to use Form I-601 to explain why your application should still be accepted even though you are not allowed to be there. This will be sent in with your application.
Next, to change your status, you need to fill out Form I-485
Among these are your:
- Keep track of when you enter and leave the United States.
- Notice that your request for a K-1 Fiancé Visa has been grant
- Proof of birth and marriage
- ID from the government
- A legal passport with an entry stamp and your K1 Fiancé Visa
- Two pictures like on a passport
- Record of vaccinations
- If you have broken the law in the US, court and police records
Form I-864 (Affidavit of Support) must also be filled out by a US citizen on your account. This person is most likely your spouse. This form is proof that they will pay for your needs while you are in the USA.
